Article 1 (Purpose)

The purpose of these Terms and Conditions is to determine the rights, obligations, and other necessary matters between the Company and users regarding the use of game services (hereinafter referred to as the "Services") provided by Nishan Perera (hereinafter referred to as the "Company").

Article 2 (Definition of Terms)

The terms used in these Terms and Conditions are defined as follows, and the interpretation of terms not defined is in accordance with relevant laws and commercial practices.

1. "User" refers to a customer who agrees to these Terms and Conditions and the Privacy Policy and is granted the right to use the service provided by the Company.

2. "Service" means any game service provided by the Company.

3. "Terminal" refers to wired or wireless devices such as mobile phones, smartphones, PDAs, tablets, and portable game consoles that can use the Service.

4. "Application" means any program that allows you to use the services provided by the Company.

5. "App Store Operator" refers to an open market operator that allows users to download applications provided by the Company and make In-App payments.

6. "Platform Operator" refers to a business operator that provides services in partnership with the Company and all related services.

7. "User Account" means a combination of letters, numbers, or special characters selected by the user and given by the app store operator or platform operator for the identification of the user and the use of the service.

8. "Guest ID" means a user identification number arbitrarily assigned by the platform operator for the purpose of identifying users and using services apart from user accounts.

9. "Content" refers to items produced by the Company for use in the Service.

10. "Paid content" refers to content purchased through in-app payment in order for users to enjoy a specific effect or efficacy in using the service.

11. "Free Content" refers to content that the user acquires for free while receiving gifts from other users or using the Service without purchasing through in-app payment.

12. "In-App Payment" refers to the act of paying for the purchase of paid content within the application.

Article 3 (Effect and Modification of Terms and Conditions)

(1) These Terms and Conditions shall be effective by posting them on the Company's website or notifying them through the connection screen in the application.

(2) The Company may change these Terms and Conditions to the extent that it does not violate relevant laws such as the Act on the Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Act on the Promotion of the Game Industry, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and the Content Industry Promotion Act. The changed terms and conditions will be notified to users through the official blog of the service or device notification (Push notification) 7 days before the effective date, specifying the effective date, the contents of the change, and the reason for the change. However, matters that have a significant impact on the rights and obligations of users will be notified 30 days prior to the effective date.

(3) Users may not agree to the changed Terms and Conditions, and if they do not agree to the changed Terms and Conditions, they may stop using the Service and withdraw from the Service. However, if the user does not expresse his or her intention to the Company expresses his or her intention until the effective date of the changed Terms and Conditions, or if the User continues to use the Service after the effective date of the changed Terms and Conditions, it shall be deemed that the User has agreed to the changed Terms and Conditions.

Article 4 (Establishment of Use Agreement)

(1) The service use contract is established when the customer installs and runs the application, agrees to these terms and conditions and the privacy policy, applies for service use, and the company approves the application for use. If the application is operated normally on the device after the customer's application for service use is completed, the use of the service is considered to be approved.

(2) If the user steals another person's personal information in the process of using the service, the user cannot claim the user's rights under these Terms and Conditions, and the Company may cancel or terminate the use contract. The same is considered if the user provides personal information to the platform operator and uses the service through the platform operator.

(3) The Company may not approve any of the following applications.

1. In the event that a user who has been restricted from use within the last 3 months or has been permanently restricted in accordance with the service operation policy applies for use

2. Pursuant to a contract concluded by the Company or when it is necessary to restrict the provision of services to users accessing from certain countries.

3. When applying for use for the purpose of committing illegal acts prohibited by the 「Game Industry Promotion Act」, 「Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.」, and other related laws

Article 5 (User Account Management)

(1) The Company performs all user management tasks such as the user's availability of services through the user account (including the temporary account, as follows).

(2) Users shall manage their user accounts with the duty of care as a good administrator. The Company shall not be liable for any damages caused by the user's negligent management of his/her user account or the consent of the third party to use it.

Article 8 (Obligations of the Company)

(1) The Company shall comply with relevant laws and regulations, exercise the rights stipulated in these Terms and Conditions, and faithfully fulfill its obligations in accordance with the rules of good faith.

(2) If the opinions or complaints raised by users are justified and objectively recognized, the Company will promptly handle them within a reasonable period. However, if the processing takes a long time, the reason and processing schedule will be notified to the user separately.

(3) In the event of a service failure, the Company shall do its best to repair or restore it without delay unless there is an unavoidable reason.

(4) The Company endeavours to provide convenience to users in the procedures and contents related to the contract with the user, such as the conclusion of the use contract, change or termination of the contract.

Article 6 (Obligations of Users)

(1) Users shall not use the services provided by the Company for any purpose other than the original purpose of use of the service, or engage in any of the following acts.

1. When providing personal information to the Company such as user inquiries, paid content recovery and refund requests, or winning events, using other people's personal information or writing false facts

2. Stealing or fraudulently using another user's user account, or stealing another person's payment method or information to purchase paid content.

3. Buying and selling (including gifting) content, such as paid content, with others, or acquiring and using it

4. Commercial/non-commercial use of information obtained by using the Company's service or application, or use of the service using unknown bugs, etc.

5. Using the Company's services or applications to generate property benefits for oneself or others.

6. Defame or damage others

7. Acts that infringe intellectual property rights, portrait rights, or other rights of the Company or a third party.

8. Acts that deceive a third party to gain profits, or use or use the services provided by the Company in an unhealthy manner to cause damage to a third party.

(2) Users are obliged to check and comply with the Company's official service blog or notices and amendments to the Terms of Use from time to time, and must not engage in any other acts that interfere with the Company's business.

(3) Users are responsible for the management of their user account and the device using the service, and must not allow a third party to use them. In addition, payment cancellation or refund cannot be claimed for the purchase or use of paid content caused by the user's negligence or negligence in management or permission to use the device.

(4) The Company may set and operate the Service Operation Policy, and the user must use the Service in compliance with the Service Operation Policy set by the Company.

Article 7 (Use and Suspension of Services, etc.)

(1) The Company shall commence the Service from the time the User agrees to use the Service. However, some services are provided from the specified date according to the company's needs.

(2) If the user uses the service using a temporary account (Guest ID), it is recommended to use the service using the user account because the paid content and service usage record may be deleted if the application is deleted from the device or the device is replaced (changed). If a user uses the service with a temporary account (Guest ID), the Company notifies the user in advance at the time of the first use of the service, and does not take any responsibility for the user's damage caused by the deletion of the application or the replacement of the device.

(3) If you download the application or use the service over the network, you may incur a separate fee set by the mobile carrier you subscribed to. In addition, in the case of changing devices or roaming overseas, all or part of the content may not be available, and background work may be performed in the case of downloaded and installed applications or services used over the network. In this case, additional charges may be incurred according to the characteristics of the device or mobile carrier, and the Company is not responsible in this regard.

(4) The company provides 24 hours a day, seven days a week, unless there is a special disruption in business or technology. However, if it is necessary for operation, such as regular system maintenance, server expansion and replacement, various bug patches, or service changes, the use of the service may be suspended for a certain period of time. In such cases, the Company will notify the content and time in advance through the official blog of the service or announcements in the application. However, if there is an unavoidable reason that the Company cannot notify in advance, it may be notified after the fact.

Article 8 (Service Details and Changes)

(1) Users must use the Service in accordance with these Terms and Conditions and the Service Operation Policy or Terms of Use.

(2) The company has comprehensive authority over the service, including the operation and termination of the service.

(3) The Company may restrict, suspend, or terminate all or part of the Services in any of the following cases.

1. If there is a force majeure reason such as wartime, incident, natural disaster, or national emergency

2. If there is a disruption to normal service use due to power outages, equipment failures, or congestion of usage

Article 9 (Provision of Information and Advertisement)

(1) The Company may request additional information from users in addition to the user information provided through the platform operator and/or app store operator, and the collected or provided user information will not be used for any purpose other than the purpose specified in the Privacy Policy.

(2) The Company may place advertisements on the Service, and the User agrees to be exposed to advertisements when using the Service.

(3) The Company shall not be liable for any loss or damage caused by the user accessing, participating, or transacting in the advertisement described in Paragraph 2.

(4) The Company may send advertisements to users using the device notification (Push Notification), and the user may refuse to receive it at any time by using the unsubscribe function in the application.

Article 10 (Compensation for Damages)

(1) Users shall compensate the Company for any damage caused to the Company by violating the obligations of these Terms and Conditions or in the process of using the Service.

(2) In the event that the Company receives a claim for damages or a lawsuit or other objection from a third party other than the User due to an illegal act or violation of these Terms and Conditions in the course of using the Service, the User shall indemnify the Company at its own responsibility and expense, and shall compensate for the damage caused to the Company due to the Company's failure to be exempted.
